Terms of Service

Last updated: 2026-09-10

These Terms of Service ("Terms") govern your use of RailScanner (the "Service") operated by Talya Global Lojistik Hizmetleri ("we", "us", "our"). By creating an account or otherwise using the Service you agree to be bound by these Terms.

Current stage. RailScanner is in active development. Paid subscriptions are not yet open and no payment is currently taken. The subscription clauses below describe the terms that will apply when billing opens; the status page states which services are live at any moment.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. Accounts must be registered with accurate information and used by the person or organisation named at registration.

2. Accounts and security

You are responsible for safeguarding your password and for any activity that occurs under your account. Notify us at info@talyasmart.com immediately if you suspect unauthorised access.

3. The Service

RailScanner aggregates rail freight route schedules, wagon and block tracking, operator metadata and corridor rate signals from third-party rail operators, terminals and data providers. The data is provided on a best-effort basis and may contain inaccuracies. Rail movements in particular cross multiple networks with differing publication practices, so you agree to verify time-critical information — departure, interchange, border clearance, arrival — directly with the operator before acting on it.

4. Acceptable use

You agree not to:

  • Reverse-engineer, scrape or systematically download Service data beyond your subscription quota.
  • Resell, sublicense or re-publish Service data without a written commercial agreement.
  • Use the Service to ship, broker or enable cargo that is illegal under applicable export-control, sanctions or dual-use regulations. Cross-border rail corridors frequently transit sanctioned jurisdictions; compliance with the applicable regime remains your responsibility.
  • Probe, scan or test the vulnerability of the Service without written authorisation.
  • Use the Service in a way that overloads our infrastructure or degrades it for other users.

5. Subscription, fees and renewal

Once billing opens, paid plans are billed monthly in advance through Payfyio, our payment processor. Payfyio presents a hosted checkout page and routes the transaction to a licensed acquirer; RailScanner never receives or stores your card number. Subscriptions renew automatically until cancelled from your account billing page. Refunds for partial periods are not provided except where required by law. Quotas (consignment bookings, route searches, tracking lookups) reset on the first day of each calendar month at 00:00 UTC.

Prices may change. We will give at least 14 days' notice for any price increase that affects your subscription, by email and through an in-app banner.

6. Rates, markup and booking requests

Where we surface a rate we may act as a reseller: the price shown to you includes our stated margin on top of the net upstream rate, and that margin varies by plan tier as published on the pricing page. Our margin affects price only — it never changes the ranking of results.

A booking request submitted through the Service is a request, not a confirmed contract of carriage. Capacity, price and transit time are subject to confirmation by the operator, and the contract of carriage itself is governed by the applicable consignment-note regime (for example CIM under COTIF, or SMGS) between you and the carrier.

7. Cancellation

There is no free tier. All plans are paid and start at $1.99/month (Starter). Subscriptions renew automatically each month until cancelled. You may cancel at any time from your billing page — cancellation stops future renewals, and your access continues until the end of the current paid period. We do not provide pro-rated refunds for partial months. We may rate-limit, suspend or withdraw access without notice if we detect abuse, automation, sustained over-quota use or fraudulent payment activity.

8. Intellectual property

RailScanner, the RailScanner mark, the platform UI, brand assets, code, documentation and the curated databases we maintain (station registry, operator registry) are our intellectual property or that of our licensors. Operator names, logos and trademarks shown on the Service remain the property of the respective operators and are used for informational reference only.

9. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted availability. We do not guarantee that the Service will be error-free, that defects will be corrected, or that the underlying operator data will be complete or current.

10. Limitation of liability

To the maximum extent permitted by applicable law our aggregate liability arising out of or related to the Service will not exceed the greater of (a) the fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim or (b) one hundred US dollars (USD 100). We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profit, cargo, revenue, goodwill or data.

11. Termination

You may cancel your account at any time from the billing page or by emailing us. We may suspend or terminate your account if you breach these Terms, if your payment fails after reasonable notice, or if continuing to serve you would expose us to legal risk. On termination you lose access to paid features; we will keep your account record for the period required by law and then delete it.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or a prominent in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

13. Governing law and venue

These Terms are governed by the laws of the Republic of Türkiye. Any dispute that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the courts and execution offices of Istanbul (Çağlayan), Türkiye.
